Privacy Policy

Effective Date: May 14, 2025

At Kuska Autism Services, your family’s privacy, trust, and confidentiality are our top priorities. This Privacy Policy explains how we collect, use, and protect your information, including how we comply with the Health Insurance Portability and Accountability Act (HIPAA).

1. Information We Collect

We may collect personal and health-related information that you voluntarily provide, including:

  • Your name, phone number, email address, and city
  • Information related to your child’s autism diagnosis or care needs
  • Insurance or provider details (if applicable)
  • Any information submitted through contact forms, phone calls, or emails

We may also collect technical data (e.g., IP address, browser type) to improve our website functionality.

2. HIPAA Compliance and Protected Health Information (PHI)

Certain information we collect may qualify as Protected Health Information (PHI) under HIPAA. PHI includes any health-related information that identifies you or your child and relates to diagnosis, treatment, or payment for healthcare services.

Kuska Autism Services complies with all HIPAA regulations. We:

  • Safeguard PHI using administrative, physical, and technical safeguards
  • Limit access to PHI to authorized personnel only
  • Require written authorization before using or disclosing PHI for purposes beyond treatment, payment, or healthcare operations (unless required by law)

3. How We Use Your Information

We use personal and health information solely to:

  • Respond to inquiries and coordinate services
  • Provide individualized support and care
  • Contact you about appointments or service updates
  • Fulfill legal or billing requirements

We do not sell, rent, or share your information for commercial marketing purposes.

4. Sharing and Disclosure of Information

We may share information:

  • With authorized team members or healthcare providers involved in your child’s care
  • With insurance companies or billing entities (with appropriate safeguards)
  • As required by law or in response to a legal request (e.g., court order or subpoena)

All sharing is done in compliance with HIPAA and only on a need-to-know basis.

5. Your Rights Under HIPAA

As a parent or legal guardian, you have the right to:

  • Access and receive copies of your child’s records
  • Request corrections to inaccurate information
  • Request restrictions on how we use or share PHI
  • Receive an accounting of disclosures
  • File a complaint if you believe your privacy rights have been violated

To make a HIPAA-related request, please contact us at 801-980-7970.

6. Security Measures

We implement industry-standard practices and technologies to secure your data. These include encrypted communications, secure data storage, and access controls. Staff are trained on confidentiality and privacy best practices.

7. Children’s Privacy

We only collect information about children with parental or guardian consent. All information is handled in accordance with both general privacy principles and HIPAA requirements.

8. Text Messaging (SMS) and Your Mobile Information

If you provide your mobile phone number to Kuska Autism Services and agree to receive text messages, we may send you recurring text messages about scheduling, appointments, confirmations and reminders, intake and authorization updates, and care coordination.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. Information sharing with the service providers who support our messaging platform is limited to what is necessary to deliver the messages you have requested, and those providers are prohibited from using your mobile number for any other purpose.

Message frequency varies. Most recipients receive approximately 2 to 8 messages per month, and you will receive no more than 15 messages per month. Message and data rates may apply.

Send STOP to unsubscribe. Reply STOP to opt out at any time. Reply STOP to any text message from Kuska Autism Services and you will be unsubscribed; we will send one final message to confirm. Reply HELP for help, or call us at (801) 980-7970. Consent to receive text messages is not a condition of purchasing any goods or services or of receiving care from us.

Carriers are not liable for delayed or undelivered messages. Standard text messaging is not a secure or encrypted channel, so please avoid sending sensitive health information by text, and never use text messaging for a medical emergency — call 911 instead.

Full details are set out in our Terms and Conditions.
